1 DEFINITIONS
In this document “BUYER” means the organisation or person who buys goods from the SELLER; “GOODS” means the articles supplied to the BUYER by the SELLER; “SELLER” means The Water Works Studio.
2 GENERAL
These Terms and Conditions apply to all contracts for the sale of Goods by the Seller to the Buyer to the exclusion of all other terms and conditions referred to, offered or relied on by the Buyer whether in negotiation or at any stage in the dealings between the parties, including any standard or printed terms tendered by the Buyer, unless the Buyer specifically states in writing, separately from such terms, that it wishes such terms to apply and this has been acknowledged by the Seller in writing.
Any variation to these Terms and Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Seller.
3 DESCRIPTION OF GOODS
The products on the website are of a technical nature so it is not practical to publish a detailed specification for them all.
Images, descriptive matter, specifications and advertising on the site are for the sole purpose of giving an approximate description of the goods to the Buyer. For the avoidance of doubt, the Buyer hereby affirms that it does not in any way rely on any description when entering into the contract.
The Seller does not accept responsibility for any preparation work based on such specifications.
4 accuracy of product information
All product specifications, images and other information published on the website have either been made accessible by suppliers, manufacturer's, publications, publicists, or been gathered from public-domain sources. The intention of The Water Works Studio is that all information on the website should be as accurate and up to date as possible.
The Water Works Studio cannot guarantee the reliability or the accuracy of the information contained within its pages. Any action taken by the user of this website remains the responsibility of the individual.
5 Price and Payment
The total price payable for the goods will be displayed at the time when the Buyer places the order, whether or not the order has been confirmed.
The Seller is entitled to make adjustments to the price to take account of any increase in the supplier's prices, the imposition of any taxes or duties or if there has been an error or omission to the price published.
In such circumstances the Seller will inform the Buyer of the correct price and give the Buyer the opportunity to cancel the order. All prices on the website are inclusive of VAT but exclusive of delivery charges which will be payable as indicated at the time of placing the order, unless stated otherwise.
6 Delivery Time
Delivery Time takes 7 - 14 working days unless stated otherwise. The date of delivery specified by the Seller is an estimate only and shall not be of the essence of the contract. The Buyer should not book plumbers or fitters before they receive the goods.
Delivery of the Goods shall take place at the address specified by the Buyer at the time of placing the order. The Buyer shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for delivery.
7 Typographical Errors
In the event that a product is listed at an incorrect price due to typographical error or error in pricing information from our suppliers, taxes or duty changes, the Seller shall have the right to refuse or cancel any orders listed at the incorrect price whether or not the order has been confirmed.
8 Availability of Goods
All products and services are subject to availability and may be withdrawn at any time. If the Seller does not supply the goods for any reason then the Seller will not charge the Buyer for the goods and any money already paid will be refunded.
The seller will not be responsible for compensating the Buyer for any other losses sustained as a direct or indirect result of the goods not being supplied.
9 Payment Methods
All major credit and debit cards are accepted including Visa, Mastercard and Switch. On the order the Buyer must provide the Seller with the exact billing address and telephone number - the address and phone number held by the Buyer’s Bank or Credit Card Company.
Incorrect information will cause a delay in processing the order. The order will only be processed once authorisation of the credit card has been properly received.
10 Delivery Charges
All prices on the website are exclusive of delivery charges unless otherwise stated, which will be added to the price of the products at the checkout.
11 RISK
Risk in the Goods shall pass to the Buyer as soon as the Goods are delivered to the Seller’s premises. The Seller will only deliver goods to the address on the order and goods will not be left without a signature. From the time of receipted delivery of the goods the Buyer is responsible for any loss or damage to the goods. Shortages or incorrect goods supplied must be noted on the delivery consignment note at the time of delivery.
12 Force Majeure
The Seller shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to, acts of God, strikes, lock-outs, accidents, war, fire, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the Seller shall be entitled to a reasonable extension of its obligations. If the delay persists for such time as the Seller considers unreasonable, it may, without liability on its part, terminate the contract.
13 WAIVER
The failure by either party to enforce at any time or for any period any one or more of the Terms and Conditions herein shall not be a waiver of them or of the right at any time subsequently to enforce all of the Terms and Conditions of this Agreement.
14 TITLE
Title in the Goods shall not pass to the Buyer until the Seller has been paid in full for the Goods, and the Goods have been delivered and signed for at the address specified on the order.
15 Time Limitation for Notification of Claims
Damage in transit: If goods arrive in a damaged condition the Buyer must make a note on the carrier's delivery consignment note. It is the Buyer’s responsibility to inform the Seller within 24 hours.
Damaged goods should not be accepted on delivery. If damaged goods are accepted the Buyer must return the product at their own cost. The damaged product should still be noted on the consignment note.
Goods signed for: Any goods signed for are deemed as being accepted in good condition. The Seller cannot accept any responsibility for damaged goods once the items have been accepted and signed for.
Shortages: It is the Buyer’s responsibility to sign for the correct number of packages as shown on the carrier's delivery consignment note. Any shortages must be noted on the consignment note. It is the Buyer’s responsibility to inform the Seller within 24 hours.
Incorrect goods: It is the Buyer’s responsibility to notify the Seller of any incorrect goods supplied within 24 hours from delivery. All goods must be checked and notified on the delivery note.
If the Buyer accepts delivery of the products and incorrect goods have been supplied, it is the Buyer’s responsibility to return the goods. It is advised that any incorrect goods are not accepted on delivery otherwise the Buyer must return the product at their own cost.
16 Refund Policy - Internet Orders
Claims for refunds on damaged goods must be notified within 48 hours.
In the unlikely event that the Buyer is not happy with the Goods, or the Goods are unsuitable, the Seller will refund or replace the Goods. However, the Goods must be returned as new, in the original packaging and fit for transportation. On return of the Goods, the Buyer will receive a refund less carriage costs and a 25% restocking charge (the cost of processing, inspecting, re-packaging and returning the item to stock).
It is the Buyer’s responsibility to return the product once the delivery has been signed for.
Any orders cancelled before receipt of the goods will also incur a 25% restocking charge.
17 Product Guarantees
All products supplied are covered by the terms and conditions of the Manufacturer's Guarantee for a period of 12 months. This guarantee specifically excludes faults caused by accident, neglect, and misuse. In addition routine maintenance, if needed, is not covered. This does not affect the statutory rights of the Buyer.
18 Availability of Goods
All products and services are subject to availability and may be withdrawn at any time. If the Seller does not supply the Goods for any reason the Buyer will not be charged for the Goods and the Seller will refund any money already paid for them. The Seller will not be responsible for compensating the Buyer for any other losses suffered as a result of the Goods not being supplied.
19 Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the law of England and the parties hereby submit to the exclusive jurisdiction of the English Courts.
20 Delivery Time
Delivery Time takes 7 - 14 working days unless stated otherwise. However, this delivery time is only an approximation and the Seller advises all Buyers not to book plumbers or fitters before the Goods are received.
21 Delivery Charges
All prices on the website are exclusive of delivery charges unless otherwise stated. Delivery charges will be added to the price of the Goods at the checkout. Delivery charges may vary according to region and any postage price displayed is subject to change at the checkout. Postage information displayed on Goods is therefore the base price but is subject to increases based on the number of items purchased and delivery location.
Buyers in parts of Scotland are advised that postage costs could be more expensive than those displayed on the products.
22 PRIVACY POLICY
The Water Works Studio is committed to protecting your privacy. We use the information we collect about you strictly to process orders. No information collected by us from this web site will be sold, rented or loaned to anyone.
We will also collect non-transactional data should you enter a competition, request a brochure, take part in a survey and/or request a newsletter via one of the electronic forms.
We may also use the information we collect to occasionally notify you about news and information about products and services we think you may find interesting.
We will sometimes link to various third party web sites to provide you with more information. We cannot accept responsibility for any issues arising through the use of these web sites.
Cookies are alphanumeric identifiers that get transferred to your computer through your web browser to enable our systems to recognize your browser and help us to understand better what portions of our site best serve you.
